Every booking requires one person to act as the primary contact with the responsibility of reading the terms and conditions, signing the booking form and ensuring the party are all aware of the requirements of the property booked as they will be jointly bound and liable.
Payments: Payments are made via bank transfer or cash and a receipt will be provided upon receiving funds. All rates are in EURO and the relevant funds should be transferred for the amount listed, conversion rates and transfer charges are the responsibility of the booking party.
Deposit & Balance: 25% deposit is due to confirm the booking. The balance is due 10 weeks before the arrival date. Failure to make the balance payment within the timeframe may result in your booking be cancelled and charges will apply. 100% payment is due if the booking is within 10 weeks of travelling.
All cancellations must be made by sending written confirmation, and signed by the person who authorized the booking form. To compensate for the expense of processing your booking and any losses that incur such as being unable to re-sell the property, we charge the following fees:
42 – 70 days 40% Amount of cancellation fee
29 – 41 days 60% Amount of cancellation fee
28 days or less 100% Amount of cancellation fee
Check in/out: Properties are available from 3pm the day of arrival. Check out is 10am day of departure. Late checkouts can be requested but are at the sole discretion of Villas in Mijas.
Insurance: Holiday & travel insurance is essential for your own protection. We recommend all our clients arrange their own medical, accident and personal property insurance, as well as in respect of deposits and balances in the event of cancellation. We are not liable for any losses that insurance would have covered.
Covid Cover: We appreciate that travel restrictions imposed by governments may affect your travel plans therefore we endeavour to accommodate with flexibility of dates and payments where possible. Should this occur, your booking date can be changed FREE OF CHARGE to a new date. If the rates are higher, you will have to pay the difference between the original price and the price for your new dates. If they are lower, the price difference will be reflected in your booking.
If the date/villa is not available and you do not wish to extend your booking to another property then your deposit or full rental amount (which ever has been paid) will be refunded less bank transfer charges and 15% admin fee. However, our normal terms and conditions of cancellation apply IF you are able to travel (as per your countries laws, even if you must quarantine on return at your expense) but CHOOSE not to travel. This safe guards owners against loss of bookings from countries that are open to travel. Each property may have its own policies around this type of change to a reservation therefore we strongly recommend you take travel insurance that covers against Covid incidents, such as being refused to travel at an airport or other unforeseen issue. This clause is effective for bookings made from January 2021 and onwards.
Short-term rental contracts (contrato de arrendamiento de temporada) require that the tenant vacate the property when the contract ends, there is no chance to renew it but a new contract can be agreed if this complies with the laws for extensions.
The short-term condition must be specified in the contract, which duration must be agreed in accordance with the term needed to be spent in the property rented.
The rental contract must contain the following items:
o Details & ID of landlord and tenant
o Description of the property
o The contract term
o Amount of rent and payment terms
o Any other legal provisions that the parties agree
The deposits: Upon signature of the rental contract, tenants are required to pay the landlord a deposit (normally 1 month) in order to guarantee the property will be returned to the owner in the same state before occupation. The deposit will be returned when the tenant moves out, IF the property is in good condition.
The Rent: The agreed rent will be paid within the first 7 days of each month, failure to do so are grounds for court action by the landlord.
As agent for the owner, Villas in Mijas will request a signed inventory list from the tenant and ensure that the monthly management of expenses are paid to the owner account for expenses agreed and outlined in the rental contract, such as community fees, electricity, IBI etc.
